KEARNS ASKS COURT WRIT Wants Wife Enjoined From Annoying Him -- Fears Another Stroke WORRY IMPAIRED HEALTH Aged Resident Says Woman Sits on Curb in Front of Boarding Boarding House and Calls to Him The marital troubles of Martin Kearn, well to do retired farmer, aged 70, who has roomed and boarded at 211 West Elm street since his wife sued him for separate maintenance some time back, took a new turn today, when he filed in circuit court a bill for injunction in an effort to restrain his wife from annoying him, declaring that he can endure the torment no longer. He says she has worried him until he has had one paralytic stroke and that he fears she will cause him to have another. According to his bill, Mrs. Kearn haunts his boarding house day and night, follows him wherever he goes , and embarrasses him greatly by her conduct. Only last Sunday, he alleges, she created a scene at the Presbyterian church, while he was attending services. For three or four hours a day, he declares, she sits on the curb outside his boarding house to annoy him and , on one or two occasions he has called the police to remover her. She points out the house to passersby, he declares, saying: "That's where my sweetheart lives", to his intense chagrin and misery. Once, he says, she mounted the porch and screamed until the neighborhood was aroused. Kearns expresses belief that his wife is endeavoring to provoke him into striking her in order to strenghten a suit for separate maintenance that she is prosecuting. He says he is contributing $50 a month toward her support while the case is pending. The old couple were married nine years ago. Both are of distinguished appearance, and are well known, which facts have lent considerable interest to the case. Their troubles became public several years ago, when Mrs. Kearns sued for separate maintenance, charging cruelty. Then Kearns filed a cross bill, in which he charged cruelty on her part. Now today comes his bill for injunction, creating a third angle. |
