Probate records of Solomon FRANKLIN who died intestate 31 December 1891, Riley Township, Vigo County, Indiana.

In the Matter of the Estate of
Solomon Franklin, decd.
Petition in proof of Heirship for distribution.

Comes now Benjamin FRANKLIN and by his sworn petition says that said Solomon died intestate, unmarried and without any issue and that his only heirs at law consists of nieces and nephews, children of his deceased brothers and sisters. That said brothers were Thomas FRANKLIN, dec'd, and John FRANKLIN, dec'd, and his sisters were Hannah CORBY deceased and Olive HYDE deceased. That the only children and heirs of John FRANKLIN are the said Benjamin FRANKLIN of Vigo County, Indiana, Thomas B. FRANKLIN and Ester MATSLER, of San Saba County, Texas. And the only children and heirs of Hannah CORBY, deceased, were Calvin CORBY a son now living in Vigo County, Indiana, William CORBY, deceased, and Elizabeth FAIR, deceased.

The court finds from the said petition, and from oral examination in open court of said Benjamin FRANKLIN and David PUGH, that the foregoing facts are true , and it is adjudged, by the court, that said Benjamin FRANKLIN, Thomas B. FRANKLIN, and Ester MATSLER are each entitled to the one third (1⁄3) of the one fourth (1⁄4) part and that the said Calvin CORBY is entitled to the one third (1⁄3) of the one fourth (1⁄4) part of the personal property of the said Solomon FRANKLIN deceased, and said parties are entitled to received such parts in the distribution of such personal property. It is further adjudged by the Court that he Clerk of this Court shall retain enough of the funds on hand to defray expenses of further proof of Heirship herein, and the sum of fifty ($50.00) dollars from said funds is hereby allowed to Farris and Hammill for services in the proceeding which proceeding is now continued for proof of Heirship of other heirs

In the matter of the
Estate of Solomon FRANKLIN, decd.
In Proof of Heirship.

Comes now the parties hereto again, and comes said Calvin CORBY and William FAIR, residence of said County in open court and by these sworn petitions say, that they were personally acquainted in his life time with Thomas FRANKLIN, a deceased brother of said decedent and that said Thomas left surviving him the following as his only children and heirs at law to wit: Eunice MINER, Hiram FRANKLIN, Daniel FRANKLIN, deceased, Charlotte CASTO, deceased, and Reeves FRANKLIN, deceased, and that the only heir at law of the said Reeves FRANKLIN, is Fred F. POMEROY, a grandson now living in the city of Terre Haute, Indiana.

Said Affiants also say that they were acquainted with said Hannah CORBY, a deceased sister of said decedent, whose only children and heirs at law besides said Calvin CORBY, were William CORBY, a deceased son, and Elizabeth FAIR, a deceased daughter who in her lifetime was the wife of said affiant, William FAIR. That the only child and heir at law of said William CORBY, deceased is one Robert CORBY, and the only children and heirs at law of said Elizabeth FAIR, deceased, she having died prior to the death of said decedent, are Sarah A. FAIR, William FAIR, and Hulda A. SINGHURSE of Vigo County, Indiana and Mary M. ELLIS, of Tippecanoe County, Indiana.

The Court now finds that the foregoing facts are true, and adjudges that said Eunice MINER, Hiram FRANKLIN, the legal heirs Daniel FRANKLIN, deceased, and the legal heirs of Charlotte CASTO, deceased and said Fred F. POMEROY, as the only heir at law of said Reeves FRANKLIN, deceased are entitled respectfully to the one fifth (1⁄5) of one fourth part (1⁄4) of the personal estate of the said dec'd.

That said Robert CORBY, as the only heir at law, of said William CORBY deceased, is entitled to the one third (1⁄3) of the one fourth (1⁄4) part of the personal estate of the said decedent and that said Sarah A. FAIR, William FAIR, Hulda A. SINGHURSE, and Mary M. ELLIS, as the only children and heirs at law of said Elizabeth FAIR deceased, are entitled each to the one fourth (1⁄4) of the one third (1⁄3) of the one fourth (1⁄4) part, of the personal estate of the decedent.

All is ordered by the court that this matter be continued, for proof of Heirship of other heirs and day is given

Proof of Heirship

Comes now the parties and files the following proof of Heirship to wit:
Comes now Samuel HYDE and John CUMMINGS, of lawful age , and on their authority, that they are residents of the State of Illinois and were acquainted with Olive HYDE, deceased, who was a sister of said Solomon FRANKLIN. That affiant Samuel HYDE is a son of said Olive, and that Malvina CUMMINGS, the wife of John CUMMINGS, is a daughter of said Olive, and that Mary MAXWELL, a widow, now living at Humbolt, Kansas, is a daughter of said Olive, and that Elizabeth SMITH, a deceased daughter of said Olive, left as her only children and heirs at law Mary FISHER of Mahamet, Illinois and Hattie JOHNSTON of Lake City, Iowa. That Benjamin F. HYDE and Henry C. HYDE are sons of said Olive, and live at Englewood, Illinois. That Sibble JERALL is a daughter of said Olive and lives at Humbolt, Kansas. That Hannah Pauline MONTGOMERY is a daughter of said Olive HYDE, and lives at Eur, Kansas. That Amasa HYDE is a son of Olive, and lives at Rantoul, Illinois. That Rosanna MAXWELL, and Susan BLACK, both deceased, were daughters of said Olive, and left surviving them children, but these Affiants say they are unable to locate such children. Affiants further say that each of said personal named herein is entitled to the one eleventh (1⁄11) part of the one fourth (1⁄4) part of the personal estate of said decedent, and further Affiants say not.

The court having heard the proof and being advised finds that the persons mentioned in petition are the heirs of said Olive and that each are entitled to the 1⁄11 of the 1⁄4 of the estate of said Sol. FRANKLIN dec'd

Proof of Heirship

Comes now the parties and file the following proof of Heirship to wit:

Comes now Samuel HYDE of lawful age and on his verified petition shows to the Court that his is personally acquainted with the children and only heirs at law of Rosanna MAXWELL, deceased, and Susan BLACK, deceased, who were the daughters of Olive HYDE, deceased who was a sister of Solomon FRANKLIN, deceased, and on the proof made it is ordered that the said children of said Rosanna MAXWELL deceased to wit: George MAXWELL, Julia PINKSTON, Joanna LYONS, Martha BARNHARDT, Sibyl PAISLEY, Jeptha MAXWELL, Charles MAXWELL, and Robert MAXWELL, are entitled in the distribution of the estate of said Solomon FRANKLIN, each to the one eighth (1⁄8) of the one eleventh (1⁄11) of the one fourth (1⁄4) part thereof. The court further finds and orders that the children of said Susan Black to wit: Mrs. Ella RENFREW, Mrs. Mallir CLIFTON, Mrs. Sarah CARPENTER, Mrs. Cordelia GRANT, Mrs. Muia Partin, Mrs. Agnes CLIFTON, Mrs. Rose SACHMAN and Mrs. Linnir ALLEMAN, are each entitled to receive in the distribution of the estate of Solomon FRANKLIN deceased the one eighth (1⁄8) part of the one eleventh (1⁄11) of the one fourth (1⁄4) part thereof.

The court having heard the proof and being advised finds that the persons mentioned in petition are the heirs of said Rosanna MAXWELL and Susan BLACK, deceased. And are entitled to receive distribution of the estate of said Solomon FRANKLIN deceased as set out in petition.
